This Policy has been prepared to clearly, transparently, and comprehensively explain the financial terms, one-week free trial opportunity, payment rules, subscription cancellation mechanisms, non-refundability principles for B2B commercial subscriptions, exceptional refund circumstances, payment dispute procedures, and mandatory consumer rights disclosures regarding DigiPestControl SaaS services.
B2B SaaS and Refund Policy
DigiPestControl provides a 1 (one) week free trial opportunity before any paid subscription is purchased, allowing Customers to evaluate the features, system performance, and suitability of the Service for their operational needs prior to purchase.
The expiration of the free trial period does not automatically convert into a paid subscription; paid subscription access commences only when the Customer actively selects an appropriate subscription package and completes the payment transaction.
Except for verified erroneous or duplicate charges, special written commitments provided by DigiPestControl, and non-waivable statutory provisions under applicable mandatory law, subscription fees paid for commercial/B2B subscriptions are non-refundable, and partial/prorated refunds are not issued for unused subscription periods.

ARTICLE 1 – Purpose, Scope, and Contractual Nature
This DigiPestControl Subscription Cancellation & Refund Policy (“Policy”) has been established to govern the subscription models, one-week free trial opportunity, payment processes, subscription renewal and cancellation procedures, refund requests, and financial dispute resolution regarding the digital services provided by DigiPestControl.
This Policy is an integral, inseparable appendix and binding contractual document of the DigiPestControl SaaS Service and License Agreement and applies to all Customer accounts registered on the platform.
By creating an account, initiating a free trial, or purchasing a paid subscription package, the Customer is deemed to have accepted all terms and conditions set forth in this Policy in their entirety.
ARTICLE 2 – Nature of the Service and Commercial Relationship
2.1. Commercial and Professional B2B Nature
DigiPestControl is a specialized Software-as-a-Service (SaaS) and digital pest control tracking platform designed for pest control operators, corporate enterprises, industrial facilities, agricultural businesses, and commercial service providers.
Unless explicitly agreed otherwise in writing, all subscription contracts established on the platform are commercial transactions between business entities (B2B).
2.2. Corporate Subscription vs Consumer Status
Accounts registered using a company commercial title, tax identification number, corporate invoice details, professional trade email, or corporate payment instrument are recognized as commercial/corporate subscriptions.
Statutory consumer withdrawal rights and individual consumer protective remedies do not apply to commercial B2B subscriptions established for professional or commercial purposes.
2.3. Individual User Requests
Where a user legally establishes individual consumer status under applicable consumer protection legislation, statutory mandatory consumer rights are evaluated pursuant to Article 14 and Article 15 of this Policy.
ARTICLE 3 – One-Week Free Trial
3.1. Opportunity for Prior Evaluation
DigiPestControl provides prospective customers with a 1 (one) week free trial period upon initial registration to evaluate platform capabilities, module workflows, report generation, and mobile application synchronization without financial commitment.
The purpose of the free trial period is to enable the Customer to thoroughly assess whether the Service meets its operational, technical, and commercial requirements before purchasing a paid subscription.
3.2. End of the Free Trial Period
Upon completion of the 1-week free trial period, access to premium modules and operational features is temporarily locked until a paid subscription is selected.
The free trial period does not automatically convert into a paid subscription, and no fees are charged to the Customer without active, explicit purchase authorization.
The Customer is free to allow the trial period to lapse without any payment obligation.
3.3. Limitations and Conditions of the Free Trial
Free trial accounts are granted once per corporate entity or user. DigiPestControl reserves the right to limit, suspend, or terminate abusive repeated trial account creations originating from the same entity, tax ID, domain, or IP range.
Certain advanced enterprise features, high-volume SMS/email gateways, or custom integration endpoints may be restricted during the free trial period.
ARTICLE 4 – Limited Service Commitment and Scope of Warranty
4.1. "As-Is" and "As-Available" Principle
DigiPestControl provides its SaaS platform, web software, mobile applications, reporting modules, and APIs on an “as-is” and “as-available” basis to the maximum extent permitted by applicable law.
DigiPestControl endeavors to maintain continuous system availability, data security, and high performance in accordance with industry best practices; however, uninterrupted or 100% error-free operation is not guaranteed.
4.2. Technical and Operational Maintenance
DigiPestControl regularly performs infrastructure updates, security patches, performance optimizations, and server maintenance to enhance software stability and operational security.
Scheduled maintenance windows and non-critical technical glitches do not constitute a breach of contract or ground for fee refunds.
4.3. No Absolute Warranty of Commercial or Biological Results
DigiPestControl provides digital monitoring, scheduling, and documentation software. DigiPestControl does not warrant, promise, or guarantee the biological eradication of pests, business profitability, operational revenue increases, or regulatory audit outcomes resulting from the Customer's commercial pest control operations.
ARTICLE 5 – Warranty Limitations and Exclusions from Warranty Scope
Without prejudice to applicable mandatory legislation and explicit commitments provided in the SaaS Service and License Agreement, DigiPestControl does not provide an absolute guarantee regarding the following matters:
- the Service operating uninterrupted or completely error-free;
- compatibility with every device, browser, or third-party operating system;
- achieving a specific commercial outcome, sales volume, revenue, or profit;
- fulfillment of the Customer's internal operational targets;
- the Software automatically executing all country-specific, industry-specific, or customer-specific regulatory compliance mandates;
- continuous and uninterrupted availability of third-party external services.
5.1. Causes Beyond DigiPestControl's Direct Control
Issues arising from the following circumstances do not automatically give rise to warranty or fee refund claims to the extent that they remain outside DigiPestControl's direct control:
- the Customer's internet connectivity or internet service provider (ISP) outages;
- the Customer's devices, local networks, or on-premises systems;
- improper system configuration performed by the Customer;
- user error or unauthorized account usage;
- outages or disruptions in third-party APIs, services, or integrations;
- third-party cloud hosting, telecom, or network infrastructure breakdowns;
- unsupported software, modified browsers, or obsolete devices used by the Customer;
- malicious cyber activity, DDoS attacks, security intrusions, or similar events;
- events evaluated as Force Majeure under the scope of the SaaS Agreement.
ARTICLE 6 – B2B Refund Policy
In B2B transactions where the Customer purchases the Service for commercial or professional purposes, except where applicable mandatory law requires otherwise and explicit exceptions set forth in this Policy, paid subscription fees are final and non-refundable.
6.1. Legal Basis
Regarding B2B transactions in Türkiye, subscription contracts entered into with Customers acting for commercial or professional purposes do not qualify as consumer transactions.
Within the framework of freedom of contract regulated under Article 26 of the Turkish Code of Obligations (Law No. 6098), provided that mandatory statutory provisions are not violated, the parties may freely agree that subscription fees shall be non-refundable.
Accordingly, for commercial and professional B2B subscriptions, DigiPestControl applies the “No Refund” policy set forth in this Article.
6.2. Purchase Following Free Trial
DigiPestControl provides the Customer with a 1 (one) week free trial opportunity before a paid subscription is purchased, offering full opportunity to evaluate the platform's features.
By completing a paid subscription purchase, the Customer explicitly acknowledges that it made its purchasing decision having either evaluated the platform during the free trial or voluntarily waived the trial opportunity.
Following purchase of a paid subscription, the following reasons:
- the Customer changing its mind after payment;
- the Customer using the Service less frequently than anticipated;
- the Customer not using the Service at all;
- a reduction in the Customer's employee, technician, or client count;
- changes in or cessation of the Customer's commercial operations;
- a specific feature or report format no longer being needed;
- the Customer switching to another software vendor;
- the free trial period not having been fully utilized prior to purchase
do not constitute grounds for fee refunds.
6.3. Unused Subscription Period
If the Customer elects to stop using the platform, ceases operations, or cancels its subscription prior to the expiration of the active billing cycle, no partial, prorated, or remaining-term refunds will be issued for unused days, weeks, or months.
Subscription cancellation does not retroactively alter the financial obligations of the already-paid subscription term.
6.4. Non-Use of Features or Capacity
Failure of the Customer to utilize all features, maximum technician quotas, customer capacity thresholds, or storage limits included in the purchased subscription package does not create any right to a partial fee reduction or prorated refund.
6.5. Promotional and Discounted Subscriptions
Subscriptions purchased under annual discounts, promotional campaigns, bundle offers, or special commercial proposals are subject to the same non-refundability rules unless explicitly agreed otherwise in a signed commercial proposal.
ARTICLE 7 – Exceptional Circumstances for Refund
Notwithstanding the general B2B non-refundability principle set forth in Article 6, the following exceptional circumstances will be evaluated by DigiPestControl:
7.1. Erroneous or Duplicate Billing
Where duplicate charges are processed for the same transaction due to a verified technical defect in DigiPestControl or payment processing gateways, or where an amount exceeding the published subscription fee is charged, the excess or duplicate charge will be investigated and corrected promptly.
Upon verification of the billing error, the verified excess or duplicate amount will be refunded to the Customer via the original payment method.
7.2. Total Failure of Service Delivery by DigiPestControl
Where payment is successfully collected but access to the paid Service cannot be provisioned at all due to a verified error originating entirely from DigiPestControl infrastructure, and the reported issue cannot be remedied within a commercially reasonable technical timeframe, the case will be reviewed on its merits.
Depending on the specific circumstances, DigiPestControl may apply subscription period extension, account service credit, technical correction, or where legally required, an appropriate fee refund.
7.3. Mandatory Statutory Law
Where applicable mandatory consumer protection or statutory legislation in the Customer's governing jurisdiction grants a non-derogable right of withdrawal, refund, or reimbursement that cannot be waived by contract, such mandatory statutory provisions will be respected.
7.4. Special Written Commercial Commitments
Where an explicit written refund guarantee, satisfaction warranty, or service credit commitment has been executed in a customized signed agreement by authorized representatives of Seçkiner Teknoloji ve Kimya San. ve Tic. A.Ş., the terms of that specific written agreement will govern.
Verbal statements, promotional sales chatter, or unauthorized informal representations not confirmed in a formal written contract or official proposal do not constitute a binding refund guarantee.
ARTICLE 8 – Evaluation of Refund Requests
A Customer believing that an exceptional refund circumstance under this Policy exists must submit a formal written request to info@digipestcontrol.com.
To enable thorough evaluation of the request, the following information must be provided:
- Customer name and registered commercial entity title;
- registered DigiPestControl account email address;
- invoice number or transaction receipt details;
- exact date and time of the transaction;
- disputed payment amount;
- detailed description and technical evidence supporting the refund request.
Receipt of a refund inquiry does not constitute an admission of liability or automatic entitlement to a refund.
Each request is audited individually against database transaction logs, system audit trails, subscription records, contract provisions, and applicable mandatory law.
ARTICLE 9 – Erroneous, Duplicate, or Unauthorized Charges
9.1. Reporting Technical Errors
If the Customer notices a discrepancy between the authorized subscription amount and the actual charge, or identifies a double billing on its card statement, it must notify DigiPestControl immediately.
DigiPestControl will liaise with payment gateway providers (e.g., Iyzico, Stripe) to review gateway transmission logs and resolve technical discrepancies.
9.2. Notification Period and Rectification
Billing discrepancies must be reported in writing within 30 (thirty) calendar days from the transaction date.
Confirmed erroneous or duplicate transactions will be processed for refund within 14 (fourteen) business days following completion of financial verification.
9.3. Erroneous Data Entry by Customer
Charges resulting from Customer error (such as selecting the wrong tier, entering incorrect seat quantities, or failing to cancel auto-renewal before the renewal date) do not constitute billing gateway errors. DigiPestControl may, at its sole discretion, offer plan adjustments or credit allocations rather than cash refunds.
ARTICLE 10 – Subscription Renewal and Automatic Renewal
10.1. Recurring Billing Model
Unless otherwise specified during checkout, subscriptions operate on a recurring billing cycle (monthly or annually).
At the end of each subscription period, the subscription automatically renews for an equivalent term at the prevailing package rate using the stored payment method unless cancelled prior to the renewal date.
10.2. Disabling Automatic Renewal
The Customer may turn off automatic subscription renewal at any time through its DigiPestControl Dashboard Settings (under Billing / Subscription Management).
Disabling automatic renewal takes effect at the conclusion of the current prepaid billing period.
No renewal charges will occur after automatic renewal has been successfully disabled.
10.3. Pre-Renewal Notifications
For annual subscription plans, DigiPestControl sends an automated renewal reminder email to the registered account email address prior to the scheduled renewal billing date.
It is the Customer's responsibility to ensure that its registered contact email address is active, accurate, and regularly monitored.
Failure to review reminder notifications does not invalidate an authorized recurring charge.
ARTICLE 11 – Subscription Cancellation and Financial Consequences
11.1. Right of Cancellation
Customers have the unrestricted right to cancel their subscription at any time without penalty or cancellation fees.
Cancellation may be initiated directly within the platform user interface or by sending written notice to info@digipestcontrol.com.
11.2. Access Retention Until Term Expiration
Upon cancellation, the Customer's paid access remains fully active and operational until the end of the currently prepaid billing cycle.
No immediate cutoff or early forfeiture of prepaid service access occurs upon cancellation.
11.3. Termination of Automatic Charges
Successful cancellation ensures that no subsequent recurring charges will be processed against the Customer's registered payment instruments upon the expiration of the active term.
Cancellation does not entitle the Customer to a retroactive or prorated refund for any elapsed or remaining portion of the prepaid period.
11.4. Account and Data Management Following Cancellation
Following subscription expiration, Customer account data is retained in accordance with statutory retention schedules and the DigiPestControl Data Retention Policy, allowing Customers to export their pest inspection logs and records before account closure.
ARTICLE 12 – Payment Disputes and Chargebacks
12.1. Prior Direct Dispute Resolution
In the event of any billing inquiry, error, or dispute, the Customer agrees to first contact DigiPestControl Support (info@digipestcontrol.com) to achieve an amicable resolution before initiating a chargeback or payment dispute with its credit card issuer or bank.
Direct communication ensures rapid review and resolution of legitimate billing discrepancies without unnecessary banking dispute overhead.
DigiPestControl commits to reviewing all formal billing inquiries in good faith.
12.2. Chargeback Process and Service Status
Where an unjustified chargeback, fraud dispute, or payment reversal is filed without prior communication for authorized services rendered:
- the Customer's platform access may be temporarily suspended pending resolution of the banking inquiry;
- detailed system access logs, IP timestamps, and acceptance audit trails will be submitted to the acquiring bank and payment network;
- associated banking chargeback penalty fees and administrative recovery costs may be assessed against the Customer;
- DigiPestControl reserves the right to pursue lawful commercial debt collection for unpaid subscription obligations.
Lawful and verified fraud dispute proceedings are evaluated separately under banking network rules.
ARTICLE 13 – Service Interruptions, Technical Issues, and Commercial Remedy Options
13.1. Scheduled Maintenance and Downtime
DigiPestControl strives to deliver high availability across its SaaS infrastructure.
Scheduled maintenance, infrastructure upgrades, emergency security fixes, or minor service degradations announced in advance do not constitute a breach of contract or ground for fee refunds.
13.2. Commercial Remedies for Unplanned and Severe Downtime
In the event of severe, continuous, and verified unplanned downtime caused directly by DigiPestControl core systems exceeding standard Service Level thresholds:
- priority engineering and dedicated technical remediation will be deployed;
- service credits equivalent to the downtime duration may be applied to the Customer's account;
- subscription period extensions may be granted free of charge;
- tier feature upgrades may be offered for a designated duration;
- custom written settlement adjustments may be executed for enterprise accounts.
Such commercial remedies constitute the Customer's primary and exclusive remedies for service availability disruptions.
13.3. Force Majeure
Service interruptions resulting from telecommunications backhaul failures, global DNS outages, cyber terror events, or government restrictions beyond DigiPestControl's reasonable control are governed under the Force Majeure provisions of the SaaS Agreement.
ARTICLE 14 – Mandatory Rights for Consumers
14.1. Consumer Transactions in Türkiye
Where a distance contract exists in Türkiye wherein the Customer acts as an individual consumer rather than for commercial or professional purposes, Law No. 6502 on the Protection of Consumers, the Regulation on Distance Contracts, and other applicable consumer regulations are additionally evaluated.
General statutory withdrawal rights, refund mandates, preliminary information obligations, and non-waivable consumer protections under applicable consumer legislation are reserved.
14.2. Statutory Right of Withdrawal Exceptions in Digital Services
Whether a consumer transaction regarding digital products or services falls within the statutory withdrawal right exception is evaluated on a case-by-case basis considering the legal nature of the service, how and when performance commenced, whether required preliminary notices were provided, and statutory exception conditions in applicable law.
The mere creation of a user account or provisioning of access to the SaaS platform is not construed in every country and for every consumer transaction as an automatic forfeit of withdrawal rights.
ARTICLE 15 – Mandatory Consumer Law in the EU / EEA, United Kingdom, and Other Countries
15.1. European Union and EEA Consumers
Under the EU Consumer Rights Directive (Directive 2011/83/EU), individual consumers residing in the EU/EEA generally possess a 14-day statutory right of withdrawal for online digital contracts.
However, where digital content or online SaaS services begin immediately upon checkout following the consumer's prior express consent and explicit acknowledgement of the loss of the right of withdrawal (Article 16(m) of Directive 2011/83/EU), the right of withdrawal is waived upon initiation of service performance.
15.2. United Kingdom Consumers
For individual consumers in the United Kingdom, statutory protections under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 apply.
Where digital services are accessed immediately upon purchase following express consent, the statutory right of cancellation ceases in accordance with UK consumer regulations.
15.3. Other Countries
DigiPestControl complies with non-waivable mandatory consumer protection rules in all jurisdictions where it commercially offers services to genuine individual consumers.
ARTICLE 16 – Limitations of Liability and Financial Claims
16.1. Financial Cap on Liability
To the maximum extent permitted by applicable law, the total aggregate liability of DigiPestControl, its officers, employees, and affiliates arising out of or relating to subscription services, payment disputes, or this Policy shall be strictly limited to the total net subscription fees actually paid by the Customer to DigiPestControl in the 6 (six) months preceding the event giving rise to liability.
This financial limitation applies across all legal theories of contract, tort, warranty, or strict liability.
16.2. Indirect and Consequential Damages
DigiPestControl shall in no event be liable for any indirect, incidental, special, exemplary, or consequential damages, including but not limited to loss of profits, commercial revenue, business goodwill, anticipated savings, loss of data, or operational downtime.
These exclusions apply even if DigiPestControl has been advised of the possibility of such damages.
16.3. Mandatory Statutory Liability
Nothing in this Policy shall limit or exclude liability for gross negligence, intentional misconduct, death or personal injury caused by negligence, or any other liability that cannot be lawfully excluded under applicable mandatory law.
ARTICLE 17 – Payment Methods, Currency, Taxes, and Refund Operations
17.1. Payment Providers
Payments may be processed via banks, payment institutions, application stores, or other authorized payment service providers utilized by DigiPestControl.
Where a specific payment is executed via a third-party payment platform or app store, the technical execution of the payment and refund may be subject to the payment infrastructure rules of the relevant provider.
17.2. Payment Method for Refunds
Where a refund is required under this Policy or mandatory legislation, the refund is executed, to the extent technically feasible, to the original payment instrument used for the transaction or via an appropriate method permitted by the relevant payment provider.
17.3. Foreign Exchange Rate Differences
Where the payment currency differs from the currency of the Customer's card or bank account, the Customer's bank or payment provider may apply its own exchange rate, conversion fee, or banking tariffs.
In the event of an approved refund by DigiPestControl, the net local currency amount credited to the Customer's account may vary from the initial charged amount due to currency conversion rates applied by third-party financial institutions on different transaction dates.
17.4. Taxes
Applicable taxes, VAT, sales tax, or similar statutory public levies on subscription fees are calculated based on the Customer's country of residence, billing details, transaction nature, and applicable tax legislation.
In the event of a fee refund, tax adjustments and credit notes are processed in compliance with applicable tax legislation and statutory accounting rules.
ARTICLE 18 – Policy Changes and Version Management
DigiPestControl may update this Policy due to modifications in payment infrastructure, development of subscription models, addition of new payment methods, legislative updates, or changes in commercial operational frameworks.
18.1. Impact on Existing Subscriptions
Policy revisions do not retroactively eliminate rights previously accrued by the Customer in a manner disallowed by mandatory legislation.
Regarding changes materially affecting the financial terms of an active subscription, notification provisions under the SaaS Service and License Agreement and applicable legislation apply.
